Supreme Court declines to hear challenge against WA capital gains tax /local/supreme-court-declines-hear-wa-capital-gains-challenge/3946742 Tue, 16 Jan 2024 22:21:37 +0000 /?p=3946742 On Tuesday, the U.S. Supreme Court ruled that they would not take up the appeal case regarding the constitutionality of the Washington state’s capital gains tax.

The law creating the capital gains tax,Ģż was signed in 2021 by Gov. Jay Inslee and went into effect in Jan. 2022, before it was stopped by a lawsuit. The legislation created a 7% tax on the sale or exchange of capital assets above $250,000.

Opponents quickly filed court cases to try and fight the constitutionality of the tax, arguing that it was a tax on income and a violation of the that requires all taxes be “uniform upon the same class of property.”ĢżA Douglas County Superior Court judge ruled in opposition, saying that since the tax was not applied to gains below $250,000, it was not being applied uniformly.

“It violates the uniformity requirement by imposing a 7% tax on an individual’s long-term capital gains exceeding $250,000, but imposing zero tax on capital gains below that $250,000 threshold,” Douglas County Superior Court Judge Brian Huber’s ruling reads.

The challenge made its way up to the Washington State Supreme Court where, in a 7-2 ruling, the judges decided that the tax was constitutional.

“Because the capital gains tax is an excise tax under Washington law, it is not subject to the uniformity and levy requirements of Article VII. We further hold the capital gains tax is consistent with our state constitution’s privileges and immunities clause and the federal dormant commerce clause,” the said. “We, therefore, reject the Plaintiffs’ facial challenge to the capital gains tax and remand to theĢżtrial court for further proceedings consistent with this opinion.”

Washington brought in $327 million more in revenue than originally forecast, according to estimates released by the .

The credited the additional money coming in from the new capital gains tax. Now, the office predicts the state will have $66 billion for the 2023-2025 budget. The council also increased the Near General Fund forecast for the following biennium (2025-27) by about $147 million, with total expected revenues of nearly $70.5 billion, according to The Office of Financial Management.

This is not the last chance to remove the tax, with a conservative group, Let’s Go Washington, organizing to repeal the tax via a statewide referendum.

At the scene, they found the single-engine aircraft had crashed into a chain-link fence off the side of the road. The Valley Regional Fire Authority, who responded to the scene, said that the pilot survived with only minor injuries.

Auburn Police said that the plane lost power shortly after takeoff, with the pilot trying to steer back towards the airport before the crash.

Auburn Way is closed between Northeast 37th Street and Northeast 41st Street, and will be for several hours pending a National Transportation Safety Board investigation.

A 35-year-old man was arrested near the UW light rail station and was booked in King County Jail while under suspicion of assault.

On Monday, Alaska Airlines more than 140 flights at SeaTac, with dozens more delays. On Tuesday, that total is more than 300 cancelled flights in two days.

Aimie Mattinson was flying back from Hawaii when she got stranded in Seattle on her way to Salt Lake City.

“It was like a three-hour wait, and someone was supposed to call me back, and no one did, and then when we got here today, they said we would have a place to stay, but we didn’t,” Mattinson said. “I got rebooked because my husband had done it while I was on the plane, but they said there was nothing they could do while we wait here for 12 hours.”

Mattinson is glad the planes were grounded but faults Alaska Air for not providing better customer service. Mattinson is booked to fly out of SeaTac later this afternoon to Salt Lake City.

One grieving couple from Alaska told they had spent the last two days stuck at Seattle-Tacoma International Airport. They arrived Saturday only to learn their connecting flight to Atlanta to join family members mourning the loss of their granddaughter was canceled.

ā€œThat was our biggest question,ā€ said Serena Stout. ā€œWhy didn’t they let us know when we were still in Anchorage that they were canceling the flight? Why we have to get to Seattle to find that out?ā€

The Federal Aviation Administration ordered the grounding of some Boeing Max 9 operated by U.S. airlines or flown into the country by foreign carriers until they are inspected. The emergency order affects about 171 planes worldwide.

The NTSB has begun an investigation that is likely to last months.

Alaska Airlines said it had canceled 170 Sunday flights, affecting 25,000 passengers, and expects cancelations to continue through the first half of the week.

Boeing has released a statement regarding the F-A-A’s grounding of the planes, saying, “Safety is our top priority, and we deeply regret the impact this event has had on our customers and their passengers. We agree with and fully support the F-A-A’s decision to require immediate inspections of 737-9 airplanes with the same configuration as the affected airplane.”

Boeing said it supported the FAA’s decision to require immediate inspections and said it was providing technical help to the investigators.

Alaska Airlines declined a request for an interview with ³ÉČĖXÕ¾ Newsradio.

Federal regulators have not disclosed how long their investigation might take or how long the planes will need to be grounded while they are inspected. However, in a statement released Wednesday, Alaska Airlines said it expects inspections to be completed ā€œin the next few days.ā€

A spokesperson with SeaTac airport offered the following statement:

ā€œWe mostly are helping facilitate managing the rebooking lines with Alaska. Our Pathfinder staff is helping direct travelers. They’ve been using the overflow plans we’ve had due to the construction on the north end of the ticketing area. That’s opening the area where cruise ship travelers use during their season on the first floor of the garage.

Outside of that, there has been no operational impacts on the airfield or other flights. Alaska is working hard to manage the rebooking process.ā€

Since then the Health Ministry in Hamas-run Gaza said Saturday a total of 22,722 Palestinians have been killed in Israel’s subsequent assault. The count does not differentiate between combatants and civilians.

Israel has held Hamas responsible for civilian casualties, saying the group embeds itself within Gaza’s civilian infrastructure. Still, international criticism of Israel’s conduct has grown because of the rising civilian death toll.

And no one is doing anything about it,”ĢżSerrano wrote in a press release with the announcement. “As Washington’s next Attorney General, I will make it my number one job to ensure criminals are prosecuted, drug dealers are incarcerated, and our police officers know the state’s top cop has their back.”

Serrano has a Bachelor of Arts in Italian from the University of California, Davis, a Juris Doctor from Florida Coastal School of Law, and a Masters of Laws from Vermont School of Law.

The attorney has lived in Eastern Washington since 2015 and became involved with the Pasco City Council in 2017.ĢżOn Jan. 2, Serrano was elected by his fellow city council members to serve as the mayor of Pasco.

Serrano also works as the director and general counsel for the political non-profit Silent Majority Foundation, which has previously challenged the state’s COVID-19 vaccination mandate and the state’s gun control legislation.

“While I disagree with several laws in this state, as Attorney General, it will not be my job to pick winners and losers. I will use all the resources available to the office to defend the Constitution and the Constitutional laws of the state,” Serrano wrote. “I will provide a much-needed check on government overreach. The days of emergency orders are over – they will be scrutinized and litigated if any office oversteps the bounds and duties as provided by the state’s constitution and laws.”

Serrano is joining the race against two Democrat candidates, formerĢżU.S. Attorney for Western Washington Nick Brown, andĢżState Sen. Manka Dhingra.

In a poll conducted by the published in November, if the election were held, Brown and Dhingra would have about equal support, at 13% and 14%, respectively. Since there was no declared Republican candidate at the time, they placed former Republican State Representative Paul Graves, who got 38% of the vote, as a hypothetical candidate on the poll. Lastly, 34% were not sure who they planned on voting for.

If elected, Serrano would be the first Republican to serve as Attorney General since Rob McKenna in 2012.

The fire started shortly after 4 a.m., and firefighters were still on the scene at the time of reporting.

Crews are using a defensive strategy to contain the fire, using ladders and hoses to attack the fire from above. Several portions of the roof have reportedly collapsed.

It has been a point of contention for neighbors, with complaints of homeless encampments and criminal activity ever since its closure.

Tacoma Public Schools had previously announced plans to demolish the abandoned school.

Tacoma Fire advises nearby residents to keep windows and doors closed until some of the smoke clears.

Jordan once owned three restaurants in the Seattle area, winning two James Beard Awards for Best Chef: Northwest and Best New Restaurant. But in June 2021, an investigative story published in the Seattle Times uncovered more than a dozen allegations of sexual harassment and assault. No charges were filed against Jordan, and he shut down JuneBaby when a majority of his staff walked out.

Jordan reopened seven months after the article and went on The Gee and Ursula show to talk about the time he spent reflecting on the allegations, what led up to them, and how to move forward. Now, he is back on the show to talk about his decision to close the restaurant at the end of the year.

“It wasn’t an overnight decision. You know, I always thought about my staff. I thought about my own sanity, I thought about the outlook of Seattle from a dining standpoint in the years to come. And I was starting to lose my creativity and my joy of running a restaurant,” Jordan said. “When I made the decision that December 31 is going to be the last day, I cried. But I also was able to breathe.”

JuneBaby will be operating as normal through the end of the year, with reservations booking out fast to visit the famous restaurant. For New Year’s Eve, Jordan is having a blowout Southern Food buffet, with music, drinks, and dancing.

But what is next for Jordan, Gee asks, now that he has closed all of his restaurants? Is he going to move to a different city without all the baggage or stay and work on something new?

“My family is here; when I say my family, that’s my son. I’m not gonna let this city separate me from my kid. So I plan to be here. Okay, what that looks like I don’t know yet because I haven’t had time to recalibrate, and stare at a whiteboard and dream up some things.”

Legal analyst has ‘a lot of concerns’ after Colorado’s Trump ruling /gee-and-ursula/legal-analyst-colorado-trump-ruling-what-does-this-mean-for-democracy/3943859 Wed, 20 Dec 2023 22:46:14 +0000 /?p=3943859 Many are reeling after a new decision from the Colorado Supreme Court ruled that former President Donald Trump will not be allowed on the state’s primary ballot in the 2024 presidential election.

In a 4-3 ruling, the State Supreme Court ruled that Trump was ineligible for the White House under , also called the U.S. Constitution’s insurrection clause.

“A majority of the court holds that Trump is disqualified from holding the office of president under Section 3 of the 14th Amendment,” the court wrote in its 4-3 decision.

On The Gee and Ursula Show, host Gee Scott and guest host Jake Skorheim tried to get to the bottom of the law that, frankly, Jake admits he wasn’t even aware of until Wednesday morning. Legal analyst Ashlynn Mejia joined the show to help explain the law and try to make sense of how this affects next year’s election.

“I have to say my first initial thoughts were, ‘Oh, no, what kind of door has just been opened?'” Mejia said. “We’ve talked about politics a lot. And you know very well that I’m not usually the first to jump up and defend Donald Trump. That’s not really where my politics tend to lie, but I just have a lot of concerns and worries about what this means for democracy moving forward.”

The U.S. Constitution prohibits anyone who swore an oath to support the Constitution and then “engaged in insurrection” against it from holding office. It was written to keep former confederates from returning to government office, but this is the first time that it was used to affect a presidential campaign.

As it stands now, the ruling only affects Colorado ballots, and several other states have made announcements that Trump would remain on the ballot in their state’s primary or caucus.

Trump has already promised that he will appeal the case to be heard in front of the U.S. Supreme Court. Trump’s legal spokeswoman, Alina Habba, said in a statement to the Associated Press Tuesday night: “This ruling, issued by the Colorado Supreme Court, attacks the very heart of this nation’s democracy. It will not stand, and we trust that the Supreme Court will reverse this unconstitutional order.”

Mejia further said that she sees the issue as one that should be decided in an election and that it was undemocratic to have a court make rulings that would impact the election this heavily, possibly setting a dangerous precedent.

“By and large, as individuals, if we have an issue or a problem with the Supreme Court members, there’s nothing we, the people, can really do about it; it’s a largely unchecked power,” Mejia said. “So if seven individuals who are not elected by the people take an election decision away from the people, it kind of gives me room to pause and be a little bit nervous about what that means. ”

Republican National Committee chairwoman Ronna McDaniel labeled the decision “election interference” and said the RNC’s legal team intends to help Trump fight the ruling.

“They even said in their decision this is uncharted grounds. This is brand new, legal territory that we’re entering here. So, I would certainly imagine that other states are going to be looking at it to see if they should be doing the same thing,” Mejia said. “This might sound great right now if you’re not a Donald Trump fan. But what happens when it is a politician that you do support?”

So, how is the Supreme Court going to rule on the appeal? Mejia said she is ‘honestly not sure’ and anything could happen, but no matter what, the ruling will likely come soon. Colorado officials say the issue must be settled by Jan. 5, the deadline for the state to print its presidential primary ballots.

According to the Renton Police, the Renton Fire Department was called to a head-on collision between a car and a school bus around noon Tuesday.

Nobody on the bus was hurt, but two people in the car were injured and taken to the hospital. One passenger was killed in the crash. The three who were in the red sedan are all believed to be in their late teens or early 20s.

Meegan Black with Renton Police tells that the rain and slippery streets were also a factor. Police also said they have reason to believe that the driver of the car was impaired at the time of the crash.

The bus was carrying two adult students in a special education program, along with the driver and a student aid.

They were transferred to another bus, while the student aid was taken to the hospital as a precaution.

The car’s driver could face vehicular homicide charges, along with a possible DUI charge.

Representative Adam Smith, a Democrat representing Washington’s 9th district, visited the studio for a conversation with Dave Ross, covering multiple topics, including the Israel-Hamas War, immigration at the border, and what the internal workings of Congress look like these days.

The first thing on Dave’s mind is the ongoing war in Gaza, asking Smith if Israel had gone to in their attacks that have resulted in around .

Smith instead wanted to focus on what steps could be taken to quickly ensure a more peaceful outcome.

“I think one of the big misunderstandings in this conflict is we’re talking about a counter-insurgency; people say this is the wrong way to fight a counter-insurgency because a counter-insurgency is about persuading the population and targeting some isolated terrorists,” Smith said. “I think Israel’s perspective was Hamas is the government of Gaza. You know, polling suggested that 75% of the residents in Gaza supported what Hamas did on October 7; Israel thinks that they are fighting a war to eliminate a hostile government.”

“If you’re going to say yes, you have to get rid of Hamas, but you have to do it in a way that doesn’t harm civilians. That is a far more difficult thing to do than I think most people appreciate,” Smith said.

Israeli Prime Minister Benjamin Netanyahu has insisted that Israel will keep fighting until it ends Hamas rule in Gaza, crushes its military capabilities and frees all the hostages taken during the Oct. 7 attack. Hamas and other militants are still holding an estimated 129 captives.

“I think the point is we’ve got to work toward a viable Palestinian state, it’s not going to happen tomorrow. It’s not gonna happen in a couple of years,” Smith said. “But if there is no hope of that, which is sort of what Netanyahu pushed forward was there was no hope of that, you’re gonna see more violence.”

Western Washington has seen a series of demonstrations against the Israel-Hamas War, with activists calling on local representatives to be more critical of the ongoing conflict. Smith was recently the target of vandalism by pro-Palestinian protestors calling for the representative to support a call for a ceasefire.

Smith spoke to the growing divide that he is seeing between Democrats and Republicans, saying that people trying to “intimidate” any elected officials is not an acceptable way.

“I think it’s a radicalization of politics in America. And I’ve said this on both the far left and the far right. They are so convinced that they are right that the traditional rules of civil society and representative democracy don’t matter to them,” Smith said. “They think that they should intimidate as many people as possible in order to get their way.”

This kind of polarization can also be seen at the seat of government itself, with the Republican party making headlines detailing a clash in the majority party between a more moderate, traditional wing of Republicans and a group of more “extreme right-wing Republicans,” as Smith calls them.

“The whole Congress’s dysfunctional is a popular thing to say, but look, we’re trying to mediate the differences of 330 million people who are incredibly diverse. So it’s always going to be a struggle,” Smith said.

Ellis trial calls for second alternate juror, restarts deliberations again /local/ellis-trial-calls-alternate-juror-likely-delay-verdict/3943545 Tue, 19 Dec 2023 20:11:12 +0000 /?p=3943545 The judge in the trial of three Tacoma cops who are accused of killing Manny Ellis is ordering jurors to start deliberations from scratch.

On Monday, the Ellis family attorney, , said that a juror who had an illness in the family was replaced by an alternate. Now a second juror had to be replaced when they tested positive for COVID-19.

If any more jurors test positive for COVID-19, the judge said that the case could be further delayed.

In his instructions to the jury, the judge told the jury members that they had to start their deliberations over because the alternate juror was not present when deliberations began last Thursday.

“A juror’s status was changed from seated to alternate because of their unavailability due to a family concern,” Pierce County Superior Court wrote in a prepared statement. “An alternate juror has joined the other 11 jury members and they have been instructed to restart deliberations.”

Bible said that the judge did hear an accusation of juror misconduct over the weekend, but the judge decided that that person was cleared to remain on the jury.

Three officers are charged with manslaughter – and two, with an additional charge of second-degree murder – after Ellis died in their custody.

Prosecutors argue that Ellis suffocated, while defense attorneys say meth and a heart condition ultimately killed Ellis.

Bible said that the juror change will likely cause a delay in the verdict, though he points out the new juror should already be up to speed in the case.

The jury is set to deliberate until Dec. 22, and if a verdict is not reached by then, the jury will resume in the New Year, on Jan. 2.

More than 30K gallons of gas spill after pipeline leaks in Skagit Co. /local/more-than-30000-gallons-of-gas-spill-after-pipeline-leaks-in-skagit-co/3942774 Tue, 19 Dec 2023 19:33:42 +0000 /?p=3942774 State ecology workers estimate 30,000 gallons of gasoline leaked out of an Olympic Pipeline storage vault in Skagit County after a part failure at the beginning of December.

Early Sunday morning, Federal, State, and Local agencies responded to the gasoline spill near Mount Vernon. That fuel is still being cleaned out of Bulson Creek and Hill Ditch near Conway.

According to Skagit County officials, an estimated 30,660 gallons of gasoline was released when a pressure-check valve failed. Approximately 5,000 gallons of gasoline remained in the vault.

Currently, Skagit County officials have evaluated 4.4 miles of coastline and have recovered around 7,000 gallons of gasoline from the site.

BP operates the Olympic Pipeline and said an alarm did sound Sunday, with operators shutting off the fuel supply as soon as possible. The Olympic pipeline runs from Blaine to Portland.

One lane of traffic is taking turns on State Route 534 to accommodate the cleanup. Approximately 1,600 feet of absorbent and containment boom has been placed at various locations.

No gasoline has been seen on the Skagit River, and cleanup crews will continue to monitor the water. Air monitoring conducted by the Department of Ecology showed no public health risks associated with the spill at this time.

The spill prompted the precautionary closure of an elementary school on Monday, but it reopened Tuesday.

In 1999, the Olympic Pipeline spilled more than 236,000 gallons (893,360 liters) of gasoline in Bellingham and erupted in a fireball that killed three people.

“To see another spill of this magnitude from this pipeline is more than extremely disheartening,” Kenneth Clarkson, spokesman for the , said in an emailed statement to The Associated Press. “This time, we are fortunate that nobody was injured or killed; any spill, and especially one of this size, that happens near our schools and into our treasured waterways and salmon habitat is completely unacceptable.”

The EPA said in an update that people living in the Hill Ditch area may still be seeing some sheen on the water there,. as the gasoline gets trapped by plants.

No injuries to wildlife had been observed, but state ecology officials urge the public to if they see any animals in distress.

Someone had reported the woman’s body earlier on South Madison Street and called 911 when they realized she wasn’t breathing. Tacoma Fire Department went to the scene and declared the woman deceased.

No arrests have been made and the investigation is ongoing.

Marayna Rodgers, a 23-year-old medical assistant from Lynnwood, Wash., was visiting Las Vegas on Dec. 5. Two days later, her remains were found in Henderson, a suburb of Las Vegas.

Police say that Rodgers had made plans to meet with her friend, 19-year-old Sakari Harnden, and her boyfriend, 27-year-old Chance Comanche. Comanche is a former professional basketball player for the Stockton Kings, the minor league affiliate for the Sacramento Kings. The Stockton Kings were in Henderson Dec. 5 for a game against the NBA G League Ignite, based in Henderson, Nev.

According to a press release from the Las Vegas Metropolitan Police Department (LVMPD) on Dec. 7, two people went to a police substation to report Rodgers missing, telling police about her plans to meet with Harnden and Comanche.

“Early in the investigation, detectives suspected foul play and obtained video evidence to arrest Harnden and her boyfriend Comanche for their role in the kidnapping and disappearance of Rodgers,” LVMPD said in a press release.

On Dec. 14, Harnden was arrested and booked into Clark County Detention Center for kidnapping.

On Dec. 15, Comanche was arrested by the FBI in Sacramento and is pending extradition to Nevada. Comanche was released from the roster of the Sacramento Kings the same day.

Comanche, a power forward and center, played college basketball at the University of Arizona from 2015-17 before declaring for the NBA draft.

He went undrafted and signed a free-agent contract with the Portland Trail Blazers last April but played only one game.

Sacramento signed Comanche in October but waived him 10 days later, at which point he joined Stockton.

Investigators have said that multiple businesses were hit in the downtown area with graffiti with various messages like “Free Palestine,” “Stop the Genocide,” and “Ceasefire Now.”

Many of the posters depict Washington Senator Maria Cantwell, with text that reads, “Missing have you seen her soul?”

Businesses tell the Edmonds Beacon they lament the damage as they are trying to avoid political platforms.

Pro-Palestinian protesters have previously expressed a desire for demonstrations to generate public discourse about the violence in Gaza – whether the action inconveniences locals or not.

Edmonds residents recognize the goal; some even told ³ÉČĖXÕ¾ Newsradio they support the message, but they distanced political speech from the widespread vandalism overnight Friday.

Resident Morton Hurt said seeing the messages scrawled in paint markers Saturday saddened him, but it keeps the war in the Middle East – and deepening political divisions surrounding it — at the forefront of his mind.

ā€œI look at what’s happening today with real sadness,ā€ resident Morton Hurt said.

ā€œI prefer not to see that vandalism happen,ā€ he added. ā€œWe have to start figuring out how to live with other peoples’ views. Give them some respect.ā€

The Edmonds Police Department told ³ÉČĖXÕ¾ Newsradio it is still tallying the total cost to businesses and the city and that the total damages could amount to a felony-level offense.

As of Monday morning, detectives were still reviewing surveillance footage and trying to identify suspects.

The graffiti comes as thousands of miles away, the White House changes its tune to Israel, now suggesting Israel wrap up its military operations in Gaza.
