We are living through one of those post-Election Day scenarios that we were expecting, with no definitive winner, but with Trump suggesting that he has already won. Attorney General Bob Ferguson won in his own bid for reelection and joined Seattle鈥檚 Morning News to discuss the state of the election results.

Does the president have the power to tell a state to stop counting votes?

鈥淚 mean, what the president did last night was obviously so disappointing, shocking on many levels. But no, he doesn’t have that power. That doesn’t mean he won’t try. I want to be clear about that 鈥 We’ve sued him 80 times. We’ve won 97% of cases against him that we’ve litigated so far that were resolved by the courts. We would expect the same outcome if we need to have a litigation around this with him as well,鈥 Ferguson said.

A key concern no matter what happens is whether people are simply going to lose confidence in our democratic process because of exercises like this.

鈥淲hat I’ve sometimes said about this particular president is that our country and our institutions are bigger than any one person, even a president. That said, I am deeply concerned about his rhetoric, what he says, including holding a press conference in the White House late last night, essentially declaring victory, and that ballots should no longer be counted. This is a man who voted absentee, by the way. Those votes are lawful votes. Any lawful votes need to be counted,鈥 he said.

鈥淪o yes, of course I have concerns about that. To be honest, me and my team were just so focused right now on the legal aspect of this. My team鈥檚 working around the clock for weeks now to get ready for this, contemplating different scenarios, drafting complaints, drafting motions. That’s really our focus right now.鈥

Does he see a correlation between this election and the 2000 election, and how might it turn out differently?

鈥淚 think there’s a direct correlation on whether we see a repeat of the situation like we have in the past with Gore versus Bush that gets decided by the U.S. Supreme Court, based largely on just how close this election is. Does it come down to one state and a small number of ballots in a particular state? Or does Biden — and look, I’m not projecting anything here, I’m no expert — but it seems like Biden more and more has a path to that 270 that may be relatively solid right where he wins it by a bit of a margin,鈥 he said.

鈥淚 think that lessens the ability of anyone, judge or any one court, even the Supreme Court, to have frankly the desire or the willingness to engage in trying to essentially flip an election that’s not really focused on one state and a relatively small number of ballots.鈥
