Ross: Kavanaugh says he’s neutral on abortion, someday he might need to prove it

Last week, Justice Brett Kavanaugh was having dinner at a Morton’s steakhouse in DC when someone tipped off protestors, and they showed up to make a commotion. Apparently protestors these days are always on-call.

Kavanaugh was able to finish his dinner, but decided to leave through the kitchen with his security detail before dessert.

And the reaction – as usual – ran the gamut from outrage on the right, to outrage about the outrage on the left.

I hate this tactic of stalking government officials 24/7 – because over time it means only the most pugilistic people will seek government positions.

It also ruins other peoples’ dinners, and it punishes the restaurant – which is just trying to stay in business. There are reports now that Morton’s is getting swamped with phony reservations. How clever.

And yes, this is how the left operates, but I’m pretty sure that if he had voted to keep Roe v. Wade, the steak dinner would probably have been ruined just as effectively by the right… very possibly by the kind of people who smashed their way into the capitol.

I’ll bet those guys would have known to cover the kitchen exit.

So this should stop. Because it’s nasty and doesn’t change anybody’s mind. And also, because I think the people who hate Kavanaugh now – may need him someday.

If you read Kavanaugh’s argument, he actually argues that the Constitution is NEUTRAL on the subject of abortion. Not pro-choice and not pro-life. He said the court was wrong to tell the states how to deal with the issue.

And that’s significant, because there are reports the Christian right is going to test that neutrality by pushing for a federal abortion ban that would overrule even pro-choice states. A law like that could well pass three or four years from now.

If they do, it’s going to be tested within Brett Kavanaugh’s lifetime. I suppose prosecutors could just choose not to enforce such a law – but if any of them do, there is going to be a pregnant woman in a no-exception state who will claim the government forced her to give birth against her will. And if, God-forbid, she doesn’t survive– the charge could be worse than that.

Then Brett Kavanaugh will have to decide if constitutional neutrality is as benign and important as he makes it sound.

However, until then – he may want to do Door Dash.
