A federal judge has tossed out a lawsuit against Ride the Ducks Seattle.

The parents of one of the students killed in last year’s crash on the Aurora Bridge that killed five and injured more than 50 wanted to hold the tour company responsible for the emotional distress they suffered.

But the judge says only financial dependents can recover these kinds of damages. He also noted that the parents can’t legally sue because they weren’t in the country at the time of the crash; they live in Korea.

The Ducks company isn’t in the clear though. There are still several other lawsuits in the process, including accusations that they failed to properly maintain their fleet of amphibious vehicles.

A state investigation into Ride the Ducks gave the tour company an unsatisfactory rating at the end of last year, but concluded the business can resume operations in Seattle. State regulators found 442 safety violations.
